Terms of Use

These terms are the agreement between you and Forge and Lantern LLC, a Colorado limited liability company that makes and publishes RUSHERS ("we", "us"). By downloading or playing the game you agree to them. If you don't agree, please don't play.

1. Who can play

You must be old enough to agree to these terms where you live, or have a parent or guardian's permission to play. The game is not directed at children under 13. If you use the game on behalf of a child, you are responsible for their use of it.

2. Your licence to play

We give you a personal, non-exclusive, non-transferable, revocable licence to download and play RUSHERS for your own non-commercial entertainment, on devices you own or control, as allowed by the App Store's usage rules. Everything else in the game (the code, art, sound, names and marks) belongs to us or our licensors and is not sold to you. Open-source components are used under their own licences, listed in the app under Settings → About.

3. Your account

The game creates an anonymous account for you automatically. It is tied to the app on your device, so if you delete the app or lose the device, you may lose access to the account and its progress, and we may not be able to restore it. You are responsible for what happens on your account. You can delete it at any time in Settings → Account → Delete account; see the Privacy Policy for what that removes.

Your display name is seen by other players, so it must not:

Names pass an automatic filter, and players can report and block each other. We may replace a name that breaks these rules (a generated name is given instead), and we may limit name changes. Please report names that break the rules rather than responding to them.

Every Runner is the same size and speed, and ratings only mean something if races are fair. You agree not to:

6. In-game items and progress

Cosmetic items, ranks, ratings, Pass tiers, achievements and other progress are part of the game, not property. They have no monetary value, can't be sold, traded or exchanged for money, and change only the look of your Runner, never how it plays. Seasons end and some progress (such as the Rusher Pass) resets by design. We may change, rebalance or remove items and features as the game evolves. Nothing you buy changes how your Runner plays.

7. Purchases

The game is free to play. In the iPhone app you can buy optional items with real money through Apple's In-App Purchase: Gumballs (the game's virtual currency), the Rusher Pass premium track for a season, bundles, and the Rusher Club subscription. Apple takes the payment under its own terms; the price is always shown in the app, in your local currency, before you confirm, and every purchase is confirmed by you. Buying an item for a friend is a gift: it belongs to them once sent.

8. Moderation, suspension and ending your access

If you break these terms, we may replace your name, reset or remove results obtained unfairly, remove items or Gumballs obtained through cheating, fraud or refunded payments, suspend online features for your account (you can still play offline and delete your account), or end your access to the game, depending on how serious the problem is. You can stop playing and delete your account whenever you like.

9. Changes to the game

The game is free to play and still being developed. We may change, pause or stop any part of it, including online features, leaderboards and seasons, at any time. We will try to give notice in the app of significant changes where we reasonably can.

10. Feedback

If you send us ideas or feedback, we may use them to improve the game without owing you anything for them.

11. Disclaimer

The game is provided "as is" and "as available". To the fullest extent the law allows, we make no promises that it will be uninterrupted, error-free or always available, that online data (such as ratings and progress) will never be lost, or that it will meet your particular needs.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for lost data, progress or profits, arising from your use of the game. Our total liability to you for anything related to the game is limited to the greater of the amount you paid for it (including purchases in it) in the previous 12 months and US $50.

Nothing in these terms limits liability that cannot be limited by law, or takes away rights you have under the consumer protection laws of the country where you live.

13. Apple

If you got the game from Apple's App Store: these terms are between you and us, not Apple, and we (not Apple) are responsible for the game and its content. Apple has no obligation to provide maintenance or support for it. If the game fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); Apple has no other warranty obligation for the game. Apple is not responsible for any claims by you or anyone else relating to the game, including product liability, legal or regulatory compliance, consumer protection or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. Government embargo or listed on any U.S. Government list of prohibited or restricted parties. Apple's standard Licensed Application End User License Agreement also applies; if it conflicts with these terms, these terms apply to the extent the law allows.

14. Changes to these terms

We may update these terms. We will change the date at the top of this page, and tell you in the app about significant changes before they take effect. If you keep playing after that, the new terms apply.

15. General

If any part of these terms can't be enforced, the rest still applies. If we don't enforce a term straight away, we can still enforce it later. You may not transfer your rights under these terms to anyone else.
